The Biological Diversity Act, 2002 provides that when any bio-resource is accessed from any area, the local body should get a share/ royalty. Please refer to the following sections of Biological Diversity Act, 2002:
Section 3 to 7 (Access); sections 18 to 47 (functions and powers of NBA, approval of NBA, third party transfer, determination of benefit sharing); sections 49 to 53(settlement of disputes, appeal); sections 55 to 58 (penalties); and sections 60 and 61(Offences).
Procedure for access to collection of biological resources for commercial utilization
As per Section-7 of Biological Diversity Act, 2002 and Rule-14 of Jharkhand Biological Diversity Rule, 2007, any citizen of India or a body corporate, association or organization which is registered in India, desirous of obtaining any biological resource for commercial utilization, or biosurvey and bio-utilization for commercial utilization shall give prior intimation to the Board in Form I.
The application shall be in prescribed Form-1 along with Form A annexed to the regulations on Access to Biological Resources and Associated Knowledge and Benefits Sharing Regulations, 2014.
Application shall be accompanied by a fee of Rs. 10,000/- in the form of a demand draft drawn in favour of “Jharkhand Biodiversity Board” payable at Ranchi.
